Kitaro LLC (“Kitaro”, "us", "we", or "our") operates this website, including the webpages and services delivered through the domain kitaro.co (collectively, the "Site"). At Kitaro, we understand your concerns about privacy and are committed to protecting it through our compliance with this notice.
Kitaro may modify this Privacy Notice from time to time in our sole discretion. We will provide notice by, at a minimum, updating this posting. You are expected to carefully review this Privacy Notice from time to time so you are aware of any changes. However, if we make material changes to this Privacy Notice, we will notify you either through the email address you have provided us or by means of a prominent notice on the Site before the change becomes effective. By using the Site, you agree to be bound by any such changes and to Kitaro’s collection and sharing of your information, including confidential information and personally identifiable information, according to the terms of the then-current Privacy Notice.
Information We Collect
We collect information you share through the Site. We may collect personally identifiable information, such as your name, postal address, email address, phone number, name of your organization, title, or any other identifier by which you may be contacted online or offline (“PII”) only when you have voluntarily provided such PII to us (e.g., through registration, contact inquiries, etc.). As a general rule, we only use PII to communicate with you regarding our products and services, or for any other purpose for which you have divulged the data to us, such as to answer your inquiries or to grant you access to password protected portions of the Site.
We may also collect information concerning you or an entity that you represent, including, but not limited to, the kind of product or service you are seeking from Kitaro or Request for Proposal information (“RFP Information”) that may include detailed and sensitive information about proposed projects, such as sales, job, salary, and capital investment data, as well as information about the workforce, sites and buildings, utilities, community engagement, and economic incentives. In connection with providing certain services to you, you may post, upload, or otherwise provide information to or through the Site, and therefore to us, about you, the entity you represent, or your clients or customers, including RFP Information (“Client Information”). The Client Information you provide to us may include PII or other sensitive or confidential information about you, the entity you represent, or your clients or customers. Except when used to provide the specific services you request from us, all PII and Client Information is de-identified before being combined with other user’s de-identified personally identifiable information and client information to provide other products or services to you or any of our other clients. As used in the preceding sentence and in this Privacy Notice, “de-identified” means the removal or obfuscation of any personal or client identifiers in a way that minimizes the risk of unintended disclosure of the identity of individuals or entities and information about them, including, but not limited to, the removal of entity names. By using the Site to provide us with Client Information, you represent and warrant to us that the Client Information complies with all applicable law and your policies and procedures addressing administrative, technical, and physical safeguards to protect customer records and information.
Our web server and/or the Analytics Technologies may collect and store the following general information about you: the Internet protocol address (the Internet address of your device), the originating name of the domain from which you access the Internet; the date and time you access the Site; the pages of the Site you visit; the Internet address of the website from which you linked directly to the Site; and the type of device, device ID and web browser you use to access the Site. This information is collected automatically. It is used to help us improve the Site by tabulating the number of visitors to the Site in terms of new users, origin of referrers, popularity of pages, amount of use, types of errors, and to make the Site more useful to you. We also analyze this information for certain trends in statistics, such as which parts of the Site users are visiting and how long they spend there.
The Analytics Technologies may also use “cookies” and “web beacons.” Cookies are small files stored on your computer's hard drive that are used to store and track personal information. Cookies are used by the Analytics Technologies to remind us of who you are in order to deliver you better service. Web beacons are small electronic files (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Analytics Technologies, for example, to count users who have visited certain pages and for other related Site statistics (for example, recording the popularity of certain Site content and verifying system and server integrity).
Do Not Track Policy
We may also use these automatic data collection technologies to collect information about your online activities over time and across third-party websites or other online services (“Behavioral Tracking”). “Do Not Track” is a proposed standard that is currently under development. As it is not yet finalized, we adhere to the standards set out in this Privacy Notice and we do not currently respond to “Do Not Track” signals on the Site or on third-party websites or online services where we may collect information. The information we collect automatically is statistical data and does not include PII, and we only maintain it or associate it with PII to the extent necessary to link your session to your user account.
We do not control these third parties' tracking technologies or how they may be used. If you have any questions about targeted content, you should contact the responsible party directly. For information about how you can opt out of receiving targeted advertising from certain providers, see “Choices About How We Use and Disclose Your Information.”
We may use your PII to contact you with newsletters, marketing or promotional materials and other information that is pertinent to the use of the Site. By using the Site, you are consenting to this.
What Information is Shared and With Whom
We do not rent or sell your PII to outside marketers, but we may sell your de-identified Client Information to outside marketers or our other clients. Kitaro may share your information (as described in this Privacy Notice) with its affiliates, subsidiaries, or divisions and with their respective officers, directors, employees, accountants, attorneys, and agents, or with Kitaro’s business partners. In certain circumstances, we may share data with vendors to help us provide you with products and/or services that you requested from us, perform statistical analysis, send you email or postal mail, or provide customer support. All such third parties are required to maintain the confidentiality of your information and are prohibited from using your PII except to provide services to Kitaro or as required by law.
We may provide information to regulatory authorities and law enforcement officials in accordance with applicable law or when we otherwise believe in good faith that the law requires it. There may be instances when we may access or disclose your information in order to protect or defend the legal rights or property of Kitaro and its affiliated companies or their employees and agents, to protect the safety and security of users, and to protect against fraud.
Kitaro may sell, transfer or otherwise share some or all of its assets in connection with a merger, reorganization or sale of assets, or in the event of bankruptcy, without your permission. In such an event, PII and Client Information may be part of the assets transferred.
The Site is developed and supported by third-party vendors, who may in the course of performing their services for us have access to your PII and Client Information. We contractually require such vendors to maintain the confidentiality of your PII and Client Information and keep your PII and Client Information secure. We do not allow such vendors to use or share your PII or Client Information for any purpose other than in performing services for us.
